Hernia Patch Lawsuit

If you have had an abdominal hernia repair operation and received a surgical mesh patch since May 2002 please contact us. We have commenced an action in which it is alleged that you should be monitored for potentially serious side effects or injuries that can arise from the implantation of certain surgical mesh products commonly known as Kugel Mesh.
Claim Restricted to Patch with Rings
IMPORTANT UPDATE
On November 23, 2011, Justice Strathy approved the discontinuance of the claim in respect of hernia patches that do not contain a PET ring. The claim is now restricted to those meshes which have a ring.
If you were implanted with a mesh that does not have a ring, and you wish to continue to pursue a claim, you should immediately retain a lawyer to provide you with independent advice. There are strict time limits to pursuing such a claim so you should consult your own lawyer immediately if you want to sue because of your medical problems.
Also, please note that the hearing of the certification motion has been adjourned to 2012 to permit further evidence to be considered.

We have commenced an action in which it is alleged that you should be monitored for potentially serious side effects or injuries that can arise from the implantation of certain surgical mesh products commonly known as Kugel Mesh.
The Toronto law firm of Stevensons LLP, together with other leading Canadian firms, have commenced this national class action lawsuit on behalf of persons in Canada who received Kugel Mesh. The products are distributed in Canada by Bard Canada Inc., an affiliate of the U.S. corporations C.R. Bard, Inc. and its subsidiary, Davol Inc., all of whom are named defendants in the Canadian lawsuit.
The statement of claim was issued in the Ontario Superior Court of Justice on May 19, 2009, with similar actions in other provinces. The claim alleges that the defendants negligently breached their duty of care to patients in the development, testing, manufacture, and promotion of their Kugel Mesh products.
Faulty Kugel Mesh patches have been implicated in serious medical complications including perforation of the bowels and/or chronic intestinal fistulae—irregular connective tissue growths between the intestines and other organs. Patients have suffered internal bleeding, infections, and in some cases death.
If you were a patient of the Shouldice Hospital in Thornhill, Ontario, please note that the Shouldice Hospital has advised that they never used this mesh in any operations.
To find out whether one of the recalled Composix Kugel Mesh products were used in your surgery, you should obtain your product code labels. Your product code labels can be obtained from the hospital records department for the hospital where you had your surgery (hospital form letter). These labels are usually located on the nurses’ notes for your surgery and should be in your file at the hospital (sample product code).
If you have received a Kugel Mesh surgical patch, this class action lawsuit seeks compensation on your behalf and you may be entitled to participate.
